Work in a restricted-use area: do you need a permit in Portugal?
Building, altering, extending or demolishing in an area under an administrative easement or public-utility restriction needs a licence, unless a detail plan, subdivision or execution unit already covers those restrictions.
- Answer
- Licence
- Prior communication instead
- Where the restrictions are already provided for in a detail plan, subdivision or execution unit (art 4(2)(h))
- Exempt work
- Exempt works must still respect plans, easements and restrictions and can be inspected (art 6(8))
- Which areas
- Ask the council which easements and restrictions apply to your plot
- Council rules
- Your council can add detail in its own building regulation where the law lets it, so ask before you start.
- Legal basis
- RJUE art 4(2)(h) and 6(8), RJUE (Decreto-Lei 555/99) as republished in the Annex of Decreto-Lei 108/2026
