Swimming pool: do you need a permit in Portugal?
A swimming pool associated with a main building needs prior communication (comunicação prévia), not a full licence. You cannot choose a licence instead. Heritage and restricted areas have their own rules.
- Answer
- Prior communication (comunicação prévia)
- Condition
- The pool is associated with a main building, such as a house
- No choice
- Where prior communication applies, you cannot opt for a licence (art 4(6))
- Pool not tied to a building
- Not covered by this rule; the general rule is a licence (art 4(2)(c))
- Heritage and restricted areas
- Listed buildings, protection zones and areas under a public-utility restriction have their own rules (art 4(2)(d) and (h)); ask the council
- Before you start
- Tell the council at least 5 days before work begins, even for exempt work (art 80-A).
- Council rules
- Your council can add detail in its own building regulation where the law lets it, so ask before you start.
- Legal basis
